Managerial or supervisory capacity will not come under ID act/workman?

My friend working as Diploma engineer on contract base. He has two subordinate electricians and he earn rupees 19000 per month. Please give clarification, he comes as a workman under ID act or not? In the first paragraph of explanation of workman, which mentioned supervisory work for hire or reward will comes as a workman and in next part which mentioned, the man who have managerial or supervisory capacity will not come as a workman. In the next part a supervisor who earn ten thousand rupees will not come as a workman. Please give me a clarification?

The mere designation of being a Supervisor or Manager is not the test. The pertinent question is whether the person is employed in a supervisory capacity or discharges functions mainly of a managerial nature and draws wages in excess of Rs. 10,000/-. As regards the subordinate electricians, is he sanctioning their leave, writing their appraisal reports, sanctions increments, exercises disciplinary powers etc. Inspite of being named supervisor and drawing wages above the ceiling, one could still be workman, if the above said tests are answered in the negative.
