Facing Bond Payment Demands After Completing Terms: How Can I Secure My Experience Letter?

Bond Completion and Employer's Demands

I am serving in an MNC. I had signed a bond 2 years ago, which got completed on 25th August 2018. I resigned on 19th June and am still serving the notice period, which will end soon. Although I am serving them, the employer is still asking me to pay the bond money of 2 lakhs. The bond states, "I cannot resign, terminate, or provide a reason for termination within these 2 years."

Comparison with a Similar Case

There is a similar case involving my friend who resigned in May and was relieved without any payment. When I mention her case to them, they do not respond. I don't want to compare situations, but when I inquire about the different treatment, they simply ignore my questions.

Seeking Advice for Experience and Relieving Letters

I am feeling depressed and would like to receive my experience letter and relieving letter. What should I do?

Termination of a contract of employment becomes effective only on the date of completion of the notice period mentioned therein. If the date of expiry of the notice period actually falls after 25-08-2018, i.e., the date of completion of the 2-year bond, it becomes compliance with the bond by the employee. It is immaterial when the letter of resignation is submitted. Therefore, kindly write back to the management highlighting this legal position.

You can also approach the civil court to formally declare the contract as terminated or rescinded with no breach.

You are in depression; this is what they want. They want to harass you as these "Bond" cases do not turn in favor of the employer in the courts; hence, they are just harassing you. Therefore, do not go into depression. Instead, have a polite discussion and continuous follow-up with the company or the key person who can help you get out of this matter. Also, you can seek advice from a suitable advocate if you want to engage in a legal battle.
