PF - Is it possible to NOT cover an reappointed employee under PF - basic just above 15k?

priya-das1
Earlier we had terminated one of our employee bcoz of company condition, but now we had reappointed the same employee.
First he was covered under PF but now we have increased his basic i.e 15030/- & we dont want him to be covered under PF.
Is it possible that first he was covered under PF now we don't want to cover him under PF?

simple example of doubtful case by department
you have increased his basic to make him out of EPF but about ESIC? using the old IP which clearly show that he was ex of your establishment
however if he has withdrawn his EPF and old UAN is closed ( i am sure that he has not got a/c 10 amount from EPF even in case of withdrawal)
better to get fixed to the ceiling amount of EPF 15000 and adhare with rules, as any such mis-declaration would invite troubles for employee and employer both

The provision of law is, once covered the employee continues to be so but upto the wage ceiling limit. It is better to adhere to what US Sharma has said above.
