Is My Security Guard Salary Structure in Karnataka Legal? Let's Discuss!

Yuvaraj Rayudu
In Karnataka, the minimum wage for a Security Guard is Rs. 11,941/- including DA.

Kindly review and comment on my salary structure whether it's legal or not.

Basic: Rs. 11,941 (Including DA)

Deductions:
- ESI (@1.75%) = Rs. 209
- EPF (@12%) = Rs. 1,433
- Uniform washing Allowance = Rs. 300

Net pay = Rs. 11,941 + Rs. 300 - Rs. 209 - Rs. 1,433 = Rs. 10,599

It depends on who is liable to deduct and pay ESI/EPF. If it is done by the principal employer, then ESI/EPF is payable on the Gross amount with no deduction. If it is maintained by the contractor, they can split it into Basic + HRA + Conveyance or washing allowance. In this case, the EPF amount would be lower.

Sir,

Deductions will be done by the Security Agency, not by the principal employer. The Karnataka government has defined the minimum wage as Basic + DA (10350 + 1591) only. In this case, how can the minimum wage of 11941 (Basic + DA) be adjusted to reduce deductions by the Security Agency?

Kindly help me to get clarity.

Follow the state rules first. If the state government has fixed the basic and DA, then it cannot be split.
