Unpaid Work on Holidays in Banks: Is It Fair for Employees to Be Forced to Work?

Unpaid Work on Holidays and Sundays in Private Sector Banks

I've observed an interesting fact about one of the reputed private sector banks in the region. The employees are required to seek permission from their reporting managers for holidays or Sundays! They are expected to work on Sundays and holidays without any extra pay. While such practices are common in the private industry, this bank took it a step further when one of the business heads issued an official email to the entire region enforcing this policy rigorously. What's more, the Regional Head approved the decision, and it has been fully implemented!

Can an Organization Enforce Such Policies?

The question is: Can an organization do this? Can the employees receive justice?

Babu Alexander
Both under the National Festival Act and the Shop and Establishment Act, this is a major violation.

How can an employee get justice, where and how to complain? Employees are under threat if they go against management/seniors; they will terminate them.

Please let me know if you need any further assistance.

Dear Bhardwaj,

Please bring this matter to the attention of the Commissioner of Labor in the respective state by filing a complaint, if possible along with a copy of the email from the Business Head.

Thank you.

Someone has to bell the cat. Discuss with your area Commissioner of Labour; he may be of great help to you.

You may contact any trade union locally active and request them to pursue legal remedy in this matter. Taking up the issue in your name or identity may have serious repercussions on the job, so better to avoid it.

Dear Friend,

If you are not willing to hog the limelight, arrange to send an anonymous letter to the Commissioner of Labour through somebody or through the union if you have a union in the bank. Your bosses are doing illegal and immoral things and are exploiting the employees.

Dear Colleague,

This is a blatant act of violation by the concerned bank management of the legal right conferred of having paid weekly off. Before knocking on the doors of the Labour Commissioner, it would be better to send a polite communication to the top authority pointing out this illegal decision and requesting its immediate reversal. If the management does not pay any heed, then surely approach the labour authorities.
