Hi, I am working in a reputed FMCG Company and have a job offer from another Company. My current employer has mentioned the following in the offer letter: "The contract of employment may be terminated by either party by serving a notice of 90 days or salary in lieu of the notice period."
Notice Period Clause
Now the present position is that my department is insisting on me serving the complete 90 days notice period, whereas I want to serve only 30 days and am willing to buy out the balance period. Can the Company make me serve the entire 90 days despite this clause in the agreement? Since there is no mention of employer discretion anywhere in the contract. Also, can they legally withhold my relieving letter?
