In TCS Chennai, Should I serve notice period after my maternity leave ends.

Hi ,
Currently I am in ‌maternity leave(26wML and 4w SML) and it will be end in December 2018 in TCS. If I am resigning Can I quit immediately without notice period of 3M and if yes when will I get my experience certificate. To whom should I inform and How. Mail access is disabled now.

Dear anony,
If you wish to quit after utilizing your maternity leaves, you have to quit as per the conditions laid down by your appointment terms unless you negotiate a way out with the management. U will get the experience letter once your dues with the organisation are cleared. You should inform your reporting manager about your resignation with a copy to hr personnel.

Maternity leave is different from Notice period.
You need to join back and then quit after giving proper resignation and notice period.
ML is a social welfare legislation for the good of women employees and needs to be viewed in that spirit.ML costs the company money, time of employee who is on leave etc etc.
Any attempt to use ML in different ways causes employer to view such socila legislation in different light.

The notice period in a company is used for transfer of knowledge and works that an employee has undergone during his/her period of work. This is one basic reason why the employers insulate the company so that they do not get overnight shock[s] from their employees.
Maternity Leave is a benefit envisaged by the Government for the women employees and since you have availed the benefit it is only prudent for you to join the company and then quit. See that you get a favourable relieving letter and recommendation as needed, in future. Do not jeopardize your future by jumping the gun.
