Navigating Resignation After Maternity Leave at TCS: Can I Skip the Notice Period?

Hi,

Currently, I am on maternity leave (26 weeks ML and 4 weeks SML), and it will end in December 2018 at TCS. If I resign, can I quit immediately without a notice period of 3 months, and if yes, when will I receive my experience certificate? Whom should I inform and how should I do it? My mail access is disabled now.

If you wish to quit after utilizing your maternity leave, you have to resign according to the conditions outlined in your appointment terms unless you negotiate an alternative arrangement with the management. You will receive an experience letter once all your outstanding dues with the organization are settled. It is important to inform your reporting manager about your resignation and also send a copy to the HR department.

Maternity leave is different from the notice period. You need to rejoin and then resign after providing proper resignation and notice period. Maternity leave is a social welfare legislation for the benefit of women employees and should be viewed in that spirit. Maternity leave costs the company money and the time of the employee on leave, among other things. Any attempt to misuse maternity leave can lead the employer to perceive such social legislation in a negative light.

The notice period in a company is used for the transfer of knowledge and work that an employee has undergone during his/her period of work. This is one basic reason why employers insulate the company so that they do not get overnight shocks from their employees.

Maternity Leave is a benefit envisaged by the government for women employees, and since you have availed of the benefit, it is only prudent for you to join the company and then quit. Ensure that you get a favorable relieving letter and recommendation as needed in the future. Do not jeopardize your future by jumping the gun.
