My spouse was working at an architecture company based in Gurgaon. During the hiring process, he was offered a position at the Gurgaon location, but later on the very first day of joining, he was asked to travel to Assam for 3-6 months, which was further extended for an undue period. During his posting, he was not given proper treatment by the managers, neither a food allowance as per the contract nor proper conveyance. He continuously complained to his HR department, but no action was taken against the said manager, nor did they change his job location. During these 8 months of on-site work, he was not allowed to take a single day of leave. After continuous requests, he was finally able to take leave after 8 months. He had applied for 22 days of leave (including weekly offs), which was not approved in writing, but a train ticket was issued to him by the company to travel back to Delhi. Due to flood situations, all the trains were canceled, and he was completely isolated. His manager was not ready to take any action, so he finally bought a flight ticket at his own cost to fly back to Delhi. During this period, he made it clear that he wouldn't be joining back in Assam and should be working from Gurgaon as per the employment contract. However, when he resumed at the Gurgaon office on the said date, he was not given any work, neither a desk to sit at, and was left idle for 2 days without any work. His manager refused to see him and humiliated him in front of all employees. Later, to his surprise, he found out from colleagues that only 3 days of leave were approved, and the rest of the days were considered leave without pay. He sent several emails to the manager and HR, but seeing no action, he resigned from the company and requested his full and final settlement. He was willingly serving his notice period, but the management forcefully relieved him on the second day of resignation. It has been more than a month, and they haven't cleared his dues nor responded to his emails/messages. Finally, he sent a legal notice to the management, and after much follow-up, they sent an email of full and final settlement with a scanned copy of a check and asked him to accept it. However, the payday calculated in the check is less, they have not paid his leave balance, nor any DA or food allowance as per the agreement. They also did not take any action against the manager who was abusive and humiliated him during his tenure.
What actions can he take against them in this case? I request your help, please.
