Family Pension Dilemma: Can a Family Claim Benefits if the Worker Passed Away Before 180 Days?

I have a query for you all regarding the Family Pension Scheme. One of our workers joined on 07 Sep 13 and passed away at home on 20 Nov 13. In this case, will his family be eligible for a pension? Typically, 180 days of contribution is required for pension eligibility.

In case of death for any reason, the employee's legal heir will be entitled to Pension.

Six-month tenure is applicable for limited to withdrawal purposes only.

Dear Sir, My brother-in-law was employed at a Gurugram-based travel agency and had worked there for more than nine months. He died in a road accident in November 2010 while returning home from the office. His company later forwarded a request to the ESI Haryana authority to grant an ESI pension on account of a job injury. My sister, along with her two minor children, has been receiving an ESI pension from November 2010 till today.

Due to ignorance, we could not follow up on the EPF-EDLI pension. Could you please guide us on whether she is eligible for an EPFO pension in the same way as ESI? If yes, what procedures are required, and what formalities need to be completed? Please narrate the details.

The nominee can apply using Form Number 20 and 10 D to receive the PF amount and Widow pension. If the children are below the age of 25 and unmarried, they are also eligible for children's pension.
