But our company HR have calculated the gratuity only on 5 years because he says if employee complete 5 years 6 months and 13 days than it will be considered only 5 years in gratuity?
The company needs to follow rules which say the time period of over six months or more is considered as one year.
Since person has complete 5 years and 6 months +13 days,the time period for gratuity becomes 6.
