Government Job Switch: Can You Get Gratuity Before 5 Years of Service?

If a government employee joined the organization in the year 2012 and applies for a job in another government organization through the proper channel, then moves out of the former organization before completing the 5 years, is the employee eligible for the payment of gratuity, or will the gratuity be transferred from the former organization to the new organization?

No such provision exists to transfer gratuity from one organization to another.

Transfer of Gratuity Between PSU and Government Departments

There is a provision for the transfer of gratuity from a PSU to a government department and vice versa if the application is submitted through the proper channel. The DPE guideline reads as follows:

The undersigned is directed to refer to the BPE’s O.M. No. 2(28)/82-BPE(GM-I) dated 14.12.1982, wherein it has been explained that whenever the transfer of an employee between one public enterprise to another is effected with the consent of the managements concerned, the concerned employee could be allowed the benefit of transfer expenses, carry forward of leave, gratuity, etc.

You should check with the HR department to inquire about the records they have maintained regarding your employment with them. You will be eligible for gratuity from the beginning if the records show continuous service from 2012; otherwise, you will not be eligible.

Furthermore, transfers from one department to another within the government are considered as one continuous service. However, government-run organizations operate independently from one another, and the eligibility for benefits may vary depending on the policies adopted by each organization.
