Can We Accept an Email Resignation and Withhold Salary for Skipping Notice Period?

Hi, I work as an HR manager for a start-up company. One of our employees (management trainee) left the job without serving the notice period. The said person sent their resignation citing medical grounds through email. Can we accept the email as a resignation letter? Also, I want to know if the company can withhold the salary for not serving the notice period.

All depends on conditions that have been mutually accepted by both the company and the employee/trainee. If the trainee has left without serving the notice period, the company is well within its rights to set off the notice period pay against dues to the trainee. The company should establish a clear policy for trainees. Make sure to outline the offer letter clearly, specifying the conditions of work/training and exit methods/procedures. It can even mention that the cost of training will be recovered if people quit in between. The cost should be reasonable, quantifiable, and proportionate.
