Understanding PF and Pension Eligibility: Can a Deceased Employee's Wife Claim Both?

One of the employees who worked with us for about 2 years and contributed to PF/Pension Fund. Some time later, after 2 months of leaving the services, he passed away. At the time of his death, he was not working anywhere. He had neither transferred his PF nor withdrawn it.

As I understand, the nominee is eligible for the withdrawal of PF. However, my question is -- Will the nominee (his wife) be eligible for the pension as well?

Yes, why not, she will be eligible.

From the employer's side, it is better to have the proofs of their marriage or legal heir certificate before processing.

Hello there,

The pension fund and provident fund are equal if the service is not more than or equal to 10 years. Up to this service duration, the employee or nominee is eligible to withdraw the total amount, including the pension amount.

The nominee of the deceased is eligible to withdraw both the PF and Pension amount since the service of the deceased is less than 10 years.

Wife of a deceased person is eligible to receive pension and deposits under EPF & EDLI. The nominee has to file the application. You have to help the family members with filling out their claim as you were the last employer.

Please correct me if I am wrong, but I don't think his wife will get EDLI benefits as he was not employed. Instead, she will receive his full PF and pension amount with interest all at once, and that's all.

The EDLI is also payable to the nominee in the event death of the employee. Please refer to para 23 and 24 of the EDLI Scheme

The queriest has stated that one of his employees who worked with us for about 2 years and thereafter contributed to PF/Pension Fund. Sometime later, after 2 months of leaving the services, he expired. He further said that when he died, he was not working anywhere. Neither did he transfer his PF nor withdraw it.

From the above statement, it is crystal clear that he was a member of the PF until his death. Hence, EDLI is payable to the nominee. This is what I understand.
