Please explain if the salary for the employee on Maternity Leave should be paid completely or partial as per the new rules.

The maternity leave is awarded with full pay on completion of at least 80 days in an establishment in the 12 months prior to her expected date of delivery. The maternity benefit is awarded at the rate of the average daily wage for the period of a worker's actual absence from work. Apart from 12 weeks of salary, a female worker is entitled to a medical bonus of 3,500 Indian rupees.

Dear Divya,
Responding to your query, Benefits related to maternity leave supposed to be paid as normal salary only. You need to pay the salary on the basis of ML on monthly basis and pay to the employee as the same practice is been followed in all over. Also, ML is for 26 weeks which is to be paid along with 3500 as bonus which will help the employee for pre and post natal care. If your pre and post natal care is been taken care by any of the medical policy hold by your company then amount of Rs. 3500/- also need not to be paid.

At the outset, the New Amendment namely: Maternity Benefit (Amendment) Act, 2017 does not speak about the mode of payment of salary to the employee on Maternity Leave. The employer has to go as per the provisions of the Principal Act. As per the provisions an employer has to pay maternity benefit at the rate of the average daily wage for the period of a worker's actual absence from work. The average daily wage means the average of the woman’s wages payable to her for the days on which she has worked during the period of three calendar months immediately preceding the date from which she absents herself on account of maternity, or one rupee a day, whichever is higher.

Maternity benefits for pre and post natal periods shall be paid @ of average wages,not as normal salary.Prenatal benefit be paid in advance.Post natal as lumpsum as soon as you get proof of delivery.
But normally companies pay it as regular salary as if the employee is on paid leave.
