I am working in a manufacturing unit and our company used to pay all its statutory payments on time, but since couple of years company is been facing financial problems and now it has become sick unit, even after deducting amount from employees salaries every month accounts department stopped generating ESI & PF challans or paying the deducted amount to concerned authorities. Being a HR person several times it was discussed with management for paying the pending dues and every time there use to tell we will arrange amount later on. Now its been two years the statutory is been pending.
Recently management informed us that there will make statutory payment from present financial year only and not the old dues. It was informed to them that if you don't pay old dues (1.5 yrs) employees will suffer and has to bear loss while withdrawing their PF amount. But instead of understanding the problem, their informed accounts team to submit a remittance letter to concerned departments for paying the payment from this financial year.
Please suggest is it possible to generate challan or make payments towards running months without clearing old dues.
