Maternity Benefits Dilemma: Is the Company Liable if Minimum Contribution Days Aren't Met?

If an employee is not fulfilling the required minimum contribution days (70 days) for the payment of maternity benefits of six months' salary under ESIC rules, is the company liable to pay the same? The total length of service is 10 months. If yes, please mention the relevant rule in this regard.

If an employee covered under ESI is not eligible for maternity benefits, the employer has to pay benefits under The Maternity Benefit Act, 1961 subject to eligibility criteria. A woman employee should receive maternity benefits. Please log in to ESI IP Portal to know the eligibility.
