Casual Leave with Wages in Factories: Is It a Must for Workers?

omchetri
Can anyone help me out with whether Casual Leave with wages is necessary for workers in a factory or not?

Hi Omchetri,

It is actually based on your standing order of the factory. Usually, 12 days of CL should be given per annum for a worker, and ensure that CL is not carried forward to the next year. If your concern has sick leave as per norms, it is not necessary to give CL, is what I was informed.

Dear Friend,

As per the Factories Act, there is no mention of CL & SL. The Factories Act speaks about Earned Leave at the rate of 1 EL for every 20 actual working days. If you have any provisions in your Certified Standing Order, Leave Rules, or HR Handbook, then you need to follow accordingly.

If it is the Shops & Establishments Act, then it is 12 CL, 12 SL, and 15 EL.

Thanks and regards,
Kamesh

Dear ANONYMOUS Friend,

In post #2, you mentioned that typically, 12 days of CL should be provided per annum for a worker, and it should be ensured that CL is not carried forward to the next year. Could you please inform us where it is stated in the law?

Thank you.
