What Happens to ESIC Membership When Gross Salary Exceeds Rs. 21,000?

Dear Professionals,

I just want to know if someone's gross salary increases to more than Rs. 21,000, is the employee bound to continue as a member of ESIC? For example, if there is an increase in salary of more than Rs. 21,000 during the contribution period, will the membership status remain unchanged? However, if an employee crosses the given limit before or after the contribution period, they will no longer be a member of ESIC.

Opting for ESIC Membership

Is it possible for an employee to choose to opt-in or continue ESIC membership once their gross wages increase beyond Rs. 21,000? Please share if there are any government orders regarding the same.

Thank you.

If the employee and employer both agree to pay contributions, there is no bar to continue. However, the wage benefits will be under a ceiling of 21000/- per month for benefits.
