Temporary Appointment as Assistant Professor
I worked as an Assistant Professor for three years with a one-day break in salary at a Central University. Every academic year, I had to pursue advertisements and appear in interviews annually. The appointment letter states my position is "purely on a temporary basis not exceeding one year or until a regular appointment is made, whichever is earlier, on the following terms and conditions:
1. You will be entitled to a salary at the minimum of the pay in the Pay Band of Rs. 15,600–39,100 + AGP 6,000/- plus allowances admissible as per the UGC and government norms.
2. Your service will be governed by the Act, Statutes, Ordinances, Regulations, and Rules of the University/GoI/UGC, which are in force and issued from time to time.
4. Your appointment is purely on a temporary basis and therefore does not vest any right to claim a regular appointment in the University or for the continuation of services in the University.
5. If any declaration/information furnished is found false or if any material/fact is found suppressed at any stage, the appointment will be terminated forthwith.
7. This appointment is purely on a temporary basis and it can be terminated anytime by the University without assigning any reason or giving any notice.
8. The employee shall have to give one month's notice or deposit an amount equal to one month's remuneration if he/she wishes to terminate his/her services in the University."
Sudden Termination of Position
All of a sudden, upon completion of my third tenure of one year in the academic session of 2016, the university orally stated: now there is no vacant post in your department, while there was a position vacant. How can the position be evacuated all of a sudden? Can I claim my job permanently?
