Resignation and Full and Final Settlement
One of my friends worked for an infrastructure company until March 2018. He submitted his resignation without giving any notice period due to personal problems. A few days later, he followed up with his reporting manager (HR Senior Manager) regarding his full and final settlement. He was advised by his reporting manager to complete all the handover formalities before he could receive the full and final settlement.
Following the suggestion, my friend completed his handover formalities and submitted all the documents to his reporting manager (Senior Manager — HR), as he had worked in the HR Department for 8 years. The Senior Manager informed my friend that he would present the case to the Managing Director for approval.
After continued follow-ups, his reporting manager stated that, as per the appointment letter, he was supposed to give three months' notice or pay three months' gross salary in lieu of notice. However, the clause in the appointment letter was applicable for up to three years only. The amount required for the notice period exactly matched his full and final settlement amount.
