Struggling to Get My Full and Final Settlement from AMW Motors – What Can I Do?

I worked with AMW Motors in Mumbai from January 2017 to June 2017. The company used to pay half the salary on a monthly basis. I resigned in May 2017 and served a one-month notice period as per the terms in the offer letter, until June 2017. Currently, I have more than 1 lakh pending in full and final settlement amount to be paid by AMW Motors.

I have reached out to the HR department, my manager, and the CEO multiple times via phone and email; however, I have not received any concrete response from any of them.

I would appreciate your advice on the steps that can be taken to prompt AMW Motors to release my full and final settlement amount.

What was your designation in the company? Did you not question the company on why only half pay was being disbursed? Any proof of half pay? Were other employees also getting half pay like you? You must now send a written communication to the company through Speedpost asking for your dues. In the letter, include full details of dues and give the last date by which you expect the money. If not done in time, approach the Labor officer or, if not possible, take legal action through an advocate.

Questioning Half Pay

Did you not question the company on why only half pay was being disbursed? - Yes, HR told me that they forgot to inform me about the company's position and regarding employees getting less salary than their actual salary.

Other Employees' Pay Situation

Were other employees also getting half pay like you? - Yes, all IT staff members were getting half pay. Now the situation is even worse; they are receiving full salary every 3 months.

Communication with HR and CEO

I have sent multiple emails to the company HR - No reply. Over the phone, she always responded by saying that she is not sure when the company will release my F&F.

When I didn't receive any response from HR, I sent emails to the CEO of the company requesting to release F&F - No response until now.

If you suspect that the company is mistreating you, it is advisable to approach the labor office. However, if there are employees within the organization who still find satisfaction in their roles, it may be wise to hold off. They could be striving towards significant objectives and eagerly anticipating the moment of achievement.

Being an Assistant Manager by designation, he may not be in the worker category, and the Labour Office will not intervene. Legal action is the only way out. It only shows the pathetic state of jobs in the economy when people are ready to work at half pay and wait for full pay to come later on. Employees need to complain en masse and keep an eye out for other job opportunities.

You may send a legal notice. Though you were given the designation of Assistant Manager, were you actually supervising, controlling work, requisitioning materials, controlling stocks, etc., and had managerial powers and responsibilities. If you were not discharging such powers, you will have the remedy under the ID Act 1947. Otherwise, you will have to knock on the doors of the Civil Court.
