Dear all, I'm a resident of Odisha. My husband was a technical manager at HCL, Noida. Due to his epilepsy problem, he remained absent from his duty, which he was unable to inform the company about. As a result, the company declared him absconded. Unfortunately, he passed away during this time.
As a widow with a small baby, I was not in a condition to go to Noida and settle the PF and pension issues. Additionally, I found out that he had not filled out a nomination form. After facing a lot of harassment, I finally went to Noida last month to address these matters. However, they are not cooperating with me to obtain the EDLI amount, stating that he is considered absconded and therefore not eligible.
From my perspective, neither the company has a police complaint report nor a written resignation from my husband. Therefore, I believe that the two months during which he was absent should be considered as service without pay. Despite this, they continue to harass me. I seek help to secure all the death benefits of my husband so that I can provide my son with a better education.
As EDLI is a government policy, the employer has nothing to pay out of his pocket; the key is in understanding the situation. Your assistance in this matter would be greatly appreciated.
