Feeling Trapped: What Can I Do If My Employer Won't Accept My Resignation?

saksena_priya
I have been working with an IT company for the past 3+ years. Last month, I got an opportunity with another organization and have resigned, but my current employer is not accepting my resignation and is harassing me. The notice period is 3 months, and according to the terms of my appointment, I will be serving 1.5 months and will buy out the balance period by paying the salary in lieu of it. This is stated in my appointment letter, which requires us to serve the notice period or pay the salary for the unserved period. My employer is threatening not to give me the relieving letter and is asking me to leave without letters if I don’t serve a 3-6 month notice and transition period.

What are my legal options?

Please help me as I am under a lot of stress and don’t want to put my career at stake. Also, please note that out of rage and anger, my current employer asked me to stop reporting to the office and said he would relieve me immediately, so I committed to an early joining with my future employers. However, after that, my current employer called me to come to the office to resolve the issue but is now not answering my emails or responding to my messages, nor are they talking to me when I approach them in the office. I am feeling harassed and lost. Please help.

Employer is not accepting my resignation nor confirming the date of relieving. They are harassing me by asking me to leave without relieving documents and being non-communicative with me.
