ESI Coverage and Sick Leave: Should ESI-Covered Employees Get Paid Sick Leave Too?

My query to the team is on ESI & Sick Leave details. Employees not covered under ESI are eligible for Sick Leave (days as per the company's decision) and can avail of the benefit, which shall be treated as paid leave. However, if an employee is covered under ESI, are they applicable for sick leave? Kindly clarify.

I do understand that employees apply for sick leave for 1-2 days, citing fever to attend to personal matters and get it approved. But for ESI-covered employees, does the organization need to sanction the Sick Leave or mark it as leave without pay, considering they can submit a claim at the ESI office for 1-2 days.

Hi Uds,

Those employees who are covered under ESIC will not get the benefit of sick leave. The sick leave provision should be as per statutory regulations for other employees. Please refer to your state's Shops and Establishment Act or Factory Act.

If an employee is availing ESIC benefits, you can mark it as ESIC Leave and deduct the salary for those days.

If an ESIC-eligible employee is not receiving benefits from ESIC, the company will cover sick leave expenses.
