Stuck Between Jobs: How to Fix Overlapping Employment Dates and Secure New Opportunities

I left company "A" on July 5th due to poor HR policy and poor salary. I joined company 'B' on July 12th without a relieving letter. Then, after one month, company 'A' provided a relieving letter on August 21 but mentioned my last working day as August 21, which I never checked. After 2 years, I got an opportunity in company 'C' where company 'C' is not accepting me due to an overlap in dates and citing dual employment. However, I did not receive any salary from company 'A' for the months of July or August. Despite this, company 'A' is not correcting my relieving letter to reflect July 5th as my leaving day. Please advise me on how to overcome this situation so that I could pursue the opportunity in company "C."

A tricky situation indeed, as Company A is not changing the relieving date. Normally, no organization would amend the relieving order after more than two years. You will have to stick to your version and could substantiate it by submitting an affidavit to that effect.

You may swear an affidavit attesting to the fact that the last day you served 'A' was on 5th July, and you never worked with them thereafter. Get the affidavit sworn before a notary. As further proof, you can produce the salary slip of July.

Three companies denied accepting the document, stating that it needed corrections from party A before they would accept it. They mentioned that an affidavit, as you suggested, would be acceptable to them.

You can mention your efforts to get it amended by 'A' but if it is not agreed upon by them, include that in your affidavit.

Without all this, can I omit my 'A' company details from my profile, not claiming or showing any experience? Could I show that B is my first company.

I do not see any fault on the part of employer "C" for not considering your relieving letter. In this case, none of your documents are correct, either from "A" or "B," if you are showing both. What is the requirement of "C"? If you have not spent a longer period in "A," then it is better not to disclose it on your CV.

You are blaming your employer "A" for having a poor salary and poor HR, but we do not see any justification for you to blame the employer. You left the employer without complying with the norms and collecting your relieving letter.

The affidavit would not be acceptable because the change of date/day is not by the swear taker but by another entity who has maintained their registers. However, one way might be possible if the concerned party is able to pursue the court and, by virtue of a direction made to "A," issue a fresh release letter with the amended date.

Thanks. I really apologize, but the victims, like us, can understand the situation. Not only me, but there are lots of employees suffering due to fake promises made by the employer during the joining process. Anyhow, I worked for 1.4 years. Can you suggest if I can omit that from my CV? That was my first company that also provided PF for the duration I worked there. Suggestions are essential.

Our silly mistakes make us suffer. It is better not to dwell on what has happened but rather to be careful in making our tomorrow better. Your priority now is to convince the HR of "C" of what other options can be followed besides amending the date by "A" or "B". Your PF will not go elsewhere if your CV is amended. Did you not transfer the PF from A to B?
