Bonus can be paid only operation department and not to support teams?

Please tell me, can a bonus be paid only to the operations department and not to support teams? Is this discrimination acceptable?

Statutory bonuses do not have a distinction based on employees, but rather on the cap imposed on their monthly salary or wages.

Thank you for the confirmation. However, my query is, does the Shop & Establishment Act and Bonus Act specify whether paying only certain departments (Operation/HR/IT) is allowed or not allowed?

Dear Mr. Sunil,

Please peruse the reply of Mr. Umakanthan once again. For the payment of Bonus, refer to The Payment of Bonus Act, 1965 & Rules, 1975. If the Bonus Act is applicable to an establishment, it applies to all those employees coming under the purview of the Act. The department/nature of duty performed has nothing to do with determining eligibility.

You have not gone through the acts you are mentioning. Please go through the same and revert with your further query, if any.

The Payment of Bonus Act, 1965

An Act to provide for the payment of bonus to persons employed in certain establishments on the basis of profits or on the basis of production or productivity and for matters connected therewith.

BE it enacted by Parliament in the Sixteenth Year of the Republic.

The wording says "Persons employed," which means all employees and not specific departments only. A reading of the Original Act is always helpful to increase knowledge.
