Joining a New Job at 59: Will I Get the Same Retirement Benefits as Others?

I am going to join a post for which the retirement age has been relaxed by the Government of India and the State Government up to 70 years. However, the entry point age should be over 35 and not more than 60. Since I am joining the post at the age of 59, will the retirement benefits applicable to all other employees of the organization at the age of 60 also apply to me? I am joining the payroll. Am I entitled to have the P.F., Gratuity, Leave Salary, etc.?

Your reply will help me make the final decision regarding joining the new organization.

PF is not mandatory after 58 years of service. Gratuity and leave are to be provided. As regards any other retirement benefits, the position has to be verified from the applicable rules.

Does this mean that apart from other retirement benefits such as Leave Salary and Gratuity, all other benefits would be applicable according to the organization's policies? Could you please clarify whether the Gratuity Act of 1972 allows for the provision of gratuity even beyond the age of 60? It is important to note that the age limit for this position has been relaxed by the Central Government through a notification.

Yes, Gratuity as per PGA 1972 is payable after continuous service of 5 years. It has no correlation with age. So even if the entire service is after 60 years of age, say from 62-67 years of age, the gratuity is payable to him.
