Whether an employee has to complete 5 years of service in order to entitled for gratuity?

Whether an employee has to complete 5 years of service in order to be entitled to gratuity? Or does completing 4 years and 240 days in the 5th year entitle him to receive gratuity? Please explain with notification and a case study.
