That will depend upon the constitution of the registered union. If the same is there, they can establish a branch of the same union in another factory, provided the other factory is situated within the same state boundaries. For other states, the Central Government will be the appropriate authority to approve the same.

Normally, wherever unions start a branch of the union in another factory within the same group, this situation will lead to the reservation of Protected Workmen.
