1. One of our employee (non-ESI) met with an accident while on duty and cut his right thumb and has been advised bed rest for a month. While the company is taking care of medical expenditure. I need clarification in two areas:-
a)Absence from duty : As advised by the doctor, should 1 month be considered as part of the leaves accrue to him as per policy or special leave/ accident on duty leave can be granted and under which ACT such special leaves are mentioned ?

Act has not defined to provide any special leave to the employee met Accident by the the employer but its employer moral & ethical duty to provide Special Leave in case if Accident Occurs with an Employee & if employee needs to take leave.

As per the Workmen's Compensation Act this is a case of temporary partial disablement. The compensation in such case is equal to 25% of wages. This is to be paid at an interval of two weeks. At the same time, the maximum salary as per the Act is Rs 8000, implying that an amount of Rs 2000 is to be paid for each fortnight.
