Employee Resignation Notice Dispute: How Should We Handle the Payment Issue?

Hi Specialists,

An employee resigned from the organization on the instruction of management with one month's notice period. However, as mentioned in his confirmation letter, the notice period was three months on either side. Now, he is claiming his two months' notice period payment, but the employer is not responding to the issue. Please advise on the further process.

Was the instruction for resignation in writing? Strictly speaking, he should have been given notice as per the agreement. One thing is certain: the company will not pay unless one takes a legal approach, which may be costlier than two months' pay.
