Can I Get My Earned Leave Encashment After Just 5 Months in a Factory?

Hi All,

I worked in a factory for only 5 months as an HR Manager. Now, they are refusing to encash my earned leave (EL) stating that my tenure is less than one year. According to the Factory Act, we need to fulfill one-third attendance, which I have met.

Please advise.
