Facing False Allegations from a Former Employee: Can We Take Legal Action?

Recently, we removed an employee from the service as he was creating a lot of problems in day-to-day work. He was also not under a signed NDA. However, he created a union and is causing more and more issues. After termination, he is still sending emails to the Government (the project was awarded by the Government for a five-year period) and misguiding them. This has made it very difficult for us to concentrate on our upcoming projects.

Today, he also attached an email and sent it to the Government, claiming that the company is forcing us to sell Ganja and other drug items. These are totally false allegations. He is sending such messages to the government, misleading them, and attempting to harm the company. Can we file a criminal case against his unpleasant emails, or can we file a civil case against him? Please advise.

Legal action against false accusations

Send him a legal notice asking him to immediately cease such false accusations and request him to withdraw and submit a public apology. If he fails to do so, legal action can be taken against him.

Before proceeding, I hope your company has terminated him by following the due process for termination. Courts can be approached only when your actions are justified. One ex-employee making allegations shouldn't disturb the company if you have taken the right actions.

Take calm actions: issue a legal notice and provide clarification to the concerned government agency about the irresponsible allegations against the company.
