Not received my last working month salary & Full & Final Settlement from my Ex Employer

Dear Sir, my name is Sunil V Solanki. I was working with PE Electronics Limited on a "third-party payroll." My co-workers and I have not received our salaries since September 2017, and some of us have left the organization due to this issue.

Dear Sunil, your employer is required by law to pay you all dues, which include salary, PF, gratuity (in case you have completed 5 years), bonus for the previous financial year (assuming you have worked for a minimum of 1 month in the previous financial year), and leave encashment if applicable.

Before approaching the Labour Commissioner's office, write an email to your company's top management, mentioning that you will approach the Labour Commissioner's office if the dues are not paid. If there is no action from them, please register a complaint with the Labour Commissioner's office, providing necessary evidence in the form of your appointment letter, payslips, and confirmation letter.

I suggest you first go to your company or client and ask whether they have received the attendance till LWD. If there was no attendance received, then that client or agency cannot give the salary. Also, check whether they received NDC with all clear details and no recovery. These cases happen only with companies that have third-party employees.

After that, you can reach the LO.
