Employee Collapsed at Work: Are We Responsible for Medical Costs Without Insurance?

murali astakala
One of the employees collapsed during working hours. He was rushed to the hospital and admitted due to some heart problems, and treatment was administered. Despite his illness, he was attending to his duties. Now, he is requesting reimbursement for medical expenses and special leave. I need clarification on whether the employer is responsible for covering medical expenses when an employee falls ill on duty. The industry is not covered under ESI, and we do not have medical insurance.

If you are not covered under ESI and Medical Insurance, you are very much governed by Workmen's Compensation Act. Both legally and the management's responsibility on humanitarian consideration towards your employees as assets of the management, you are liable to take care of his first aid expenses and leave.
