Employee wants to opt out the gratuity as it is part of CTC. Is it possible?

When an employee complete 4.6 years, he would not entitled to gratuity.
He could not have completed 190 days in a company which has 5 day working week.
Rule stipulates 5 years continuous service and mini minimum 240/190 days in last year of work.

It is an unfortunate thing that today's HR fraternity in large number do not understand / try to understand what is CTC. I have said it earlier also. There is a difference in Salary package and CTC package. One has to understand this first. If HR does not understand it then how the employee interviewed and appointed by him will understand it and convinced?

our comp.is comes under parthership.One of our emploee has expired 0n 19/3/2019.
His all details will be as followes-
Date of joining -3/2/2017
Date of expire -19/3/2019
Last Basic-12.195/-P.M.
we do not have suprerannuation scheme-under LLC.
pl.let me know how much amount company has to pay to legal heir.he is a married person.sucessar certificate is required from his wife.
