Compliance under BOCW act - Is it compulsory for medical check up under the act?

We are working on the Power Projects. Our role is to erect Sub-Stations, Transmission lines, and handover to organizations such as State Electricity Boards, Power Grid, etc. on a PAN India basis. We work as contractors for them, and upon completion of the project, we move out.

Is it compulsory for a medical check-up under the act? Please guide.

Checked the BOCW Act, there is no specific provision for medical check-up of workers under the Act. However, there is a general clause that under Section 40, the appropriate government can make provision for:
(t) maintenance of medical facilities for building workers;
(u) any other matter concerning the safety and health of workers working in any of the operations being carried on in a building or other construction work.

So it has to be checked up with each state rule on the position in this regard. But, by the way, why not offer free regular medical check-ups every year for all workers at your project sites as part of your social responsibility? The benefits would far outweigh the meager cost involved in it. Moreover, it will show your genuine concern for labor welfare for the poorest section of society.

There is a Central Act under which every state is required to frame rules and establish Boards, etc. The Act alone will not provide you with all the details; you must follow the specific rules of each state where you are working. For instance, medical examinations of workers are mandated under the Maharashtra BOCW rules. Rule No. 223 outlines the details of employees who must undergo medical examinations, including construction workers, crane operators, and transport equipment/vehicle drivers.

The records of these medical examinations must be maintained in a register in Format XII, as per the Maharashtra BOCW rules. Are these examinations required to be conducted annually? Please verify this information in the respective BOCW rules.
