Festival Holiday Pay Dilemma: Is a Worker Eligible if Leave Surrounds the Holiday?

Festival holiday falls on 12.01.2018, Friday, and the worker is on leave on the 11th and 13th if he is eligible for payment. If not, in which section or rules is it mentioned?

For national holidays, we get paid, but for festival holidays, we do not.

Dear Gurubabu03,

As per the rules, the employee is on leave on the 11th and 13th, and the festival falls in between. Therefore, the festival is counted as part of his leave. "Leave ordinarily begins from the date on which leave as such is actually availed of and ends on the day preceding the date on which duty is resumed." So, there is no question of granting him payment for three days.

If you are paying for National Holiday, then you also have to pay for the Festival Holiday. So, there cannot be separate treatment as both are governed by the Act, either under NH&FH Act or the Shops & Commercial Establishment Act.
