Dear Seniors,

Can drivers be hired under the Contract Labor Act of 1970 for company-sponsored goods vehicles and employee transportation vehicles? Please provide your valuable inputs.

Best Regards,

Dear Pankaj,

If the goods carriers and the transport vehicles are owned by the establishment and you require only drivers and cleaners for running them as per your requirements, well, you can get the crew on a contract basis from a manpower supply contractor. If the requirement is 20 or more people, such engagement will come under the purview of the CLRA Act, 1970. If the vehicles with the crew are supplied by the contractor, it will not.

We can engage drivers as contractors on a roll. The only thing I suggest is to have the contractor issue an appointment order to individual drivers on a 'fixed-term contract basis', with specific mention of the client's requirements and location.
