One of the employees has quit without any prior intimation or notice period, but he doesn't want any of his work experience certificates. What action could we take from our side for not informing prior?
You can act according to the offer letter. But the best option is to ignore and carry on. You will find another candidate, and work will not be hampered. It is a waste of time to initiate legal proceedings.
If the terms of appointment indicate one month or three months' notice from either side, and if the employee has quit without giving any notice, under the provisions of Standing Orders, you can file a suit for recovering the money as liquidated damages. However, the procedure is cumbersome and time-consuming. Hence, as suggested above, forget and employ a new candidate.
