Am I Eligible for Gratuity After 4 Years and 9 Months in a Limited Company?

Dear Sir/Madam,

Please advise on the following:

"My service with Corporate Company (Limited) was 4 years and 9 months (2nd Saturday was a half working day, and 4th Saturday was off) - D.O.J 15th-Feb-2013, and the last working day was 15th-Nov-2017. Am I eligible for Gratuity? If yes, please let me know the available remedies if my company refuses to make the payment for gratuity. Your valuable comments will be highly appreciated."

With reference to the information provided by you, prima facie, you are eligible for gratuity. If not entertained by the employer, then you may resort to the labor court.

Yes, you are eligible to receive full gratuity. Four years plus 240 working days are sufficient to qualify for gratuity. If you are not successful in convincing the management, consider seeking advice from the labor department authorities or a labor consultant. When submitting a request to the management on this matter, it is advisable to do so in writing, either through registered post or by hand. Don't forget to obtain an acknowledgment.

Be positive. First, every employee has to reach out to their HR. If they say no, even after you believe you are eligible, you can post here for suggestions and complaints. Most of these problems will be resolved at their end only.

It would be ideal to first refer to your HR department and request them to allow you the gratuity payment. If it does not work, you may approach the ALC of your area, who is the controlling authority, with all facts and figures.
