Maternity Leave Under the New Law

Under the new law, maternity leave is raised from the current 12 weeks to 26 weeks, as per the Maternity Benefit (Amendment) Act 2016. Maternity leave is awarded with full pay upon completion of at least 80 days in an establishment in the 12 months prior to the expected date of delivery. Maternity leave can be availed up to eight weeks before the expected delivery date.

The maternity benefit is awarded at the rate of the average daily wage for the period of a worker's actual absence from work. A medical bonus of Rs 3500 is also provided. Sections 6 and 7 of the Maternity Benefit Act are relevant. Refer to the National Food Security Act 2013 for some additional benefits. An alternative to the Maternity Benefit Act is the ESIC Act, where entitled females receive maternity benefits.

I also advise you to write without spelling mistakes and take care of punctuation to present your question in a professional manner.

Dear All,

My concern is that if a female is appointed for a certain area of work and she is pregnant, then when is she eligible to take benefits? How many days does she need to work before she is eligible to take the benefits?

Thank you.

What is the calculation process of payment (salary) for maternity leave?

The calculation process for payment (salary) during maternity leave typically involves determining the employee's average weekly earnings or monthly salary. This amount is then used to calculate the compensation the employee will receive while on maternity leave. Factors such as any applicable laws, company policies, and individual employment contracts may also impact the payment calculation process. It is essential for employers to follow relevant regulations and guidelines to ensure that employees receive the appropriate payment during maternity leave.
