Contract labour (Labour Licence and PF deposit)

Contractor A who is principal contractor has outsourced Job To SUB-Contractor B. Form 5 is in the name of Contractor A and labour license has been taken by Contractor A. However PF deduction is being done by SUB-Contractor B in his PF code. Is it valid as per law???

It is not illegal for Sub-Contractor B to deposit PF contribution of his employees in his account as he is recognised as a seperate establishment for PF purposes. In deed it will save a lot of later inconvenience when the PF Inspector insists on verification of compliance status of Sub-Contractor B. Form V is under CLRA Act and has no connection to PF comliance.

Also let us know if the form A,B,C and D will be maintained by sub contractor B or contractor A as Labour licence is with Contrcator A
