Facing Forced Resignation and Unfair Transfer: Should I Consider Legal Action?

Issue with Employment and Forced Resignation

I have a serious problem regarding my employment with my employer:

1. They asked me to resign without any reason and stated that the company is reducing its manpower, so "we don't need you anymore, so you resign."

2. I refuse to resign as I have not made any mistakes in my job, always do my work in a proper manner and in line with standards, and have always been No.1 in my working territory. Therefore, why should I resign?

3. My employer has now transferred my work location from one place to another, and I have accepted it due to my many responsibilities for my family, so I had to agree to this transfer.

4. After accepting the transfer letter, my employer is now forcing me to sign a bond for one year, stating that they have all rights to transfer me to any designation, department, or location at any time they want, without any salary increment, transfer expenses, or any other expenses during the transfer.

5. I am very concerned about my job now due to such statements, as there is nothing mentioned like this in my appointment letter.

I kindly request your suggestions on the best solution to this problem and whether I should pursue legal action.

Dear colleague, it is commendable that you have shown courage in refusing to resign. Apparently, the management's actions are vindictive, considering the unjust conditions they are imposing on your transfer and demanding a 1-year bond. The transfer is what management wants, and there is no question of a bond for it. Do not sign any bond. Ask them to put whatever conditions they want in black and white and avoid verbal agreements. We will guide you thereafter.

Thank you very much for the valuable feedback. However, after numerous verbal discussions with the management, I am feeling increasingly depressed. They have created conditions that are putting too much pressure on me to resign voluntarily, so that I do not have to go to my transfer location and resume my duties. It seems they prefer me to resign rather than be terminated. How should I handle this situation?

Don't get depressed or lose your cool. Until they issue your transfer order in writing, stay put. Let them take any action. Don't buckle down under any pressure because by harassing you they want you to leave. They dare not terminate your service, but you don't resign on your own.

Whatever action they take in writing, revert to us.

Transfer orders are always to be given in writing. So, verbal statements are of no use. Wait for written orders of transfer. What is the usual policy of transfers? Transfer entitlements, etc.? If they violate laid down conditions, they will be open to challenge legally. Do not get depressed and lose your cool, though times are tough. Decline to sign any bond or legal papers that are out of the way and not normally asked for from other employees. You have to play a waiting game with a cool mind and be bold.
