I am 57 years old and appointed in a private company with a salary of Rs. 30,000 per month. The employer is deducting PF for other employees. Is it necessary to deduct PF for me? Can I opt out of PF? Please clarify.
If the employee has an old UAN or any EPF account from any service, then he cannot be excluded from EPF, but to continue the membership.
If the employee has no such relation with EPF, then he has to declare the same in Form 11 and make a request to the employer for his willingness to not participate in EPF.
If the company is covered under PF, then it is applicable to all salary earners. There is no option to exit or opt-out for any employee who already has a UAN.
Thank you, sir. I don't have a UAN. Previously, at my previous workplace, my employer was not deducting or showing my salary in the payroll. This employer now wants to include me in the payroll.
When you joined the company, if your salary was above ₹15,000 and you did not have a PF account at any time before (that is any running PF account), then you can opt out. If you joined earlier but the company is now covered under PF and your salary on that day was above ₹15,000, then also you can opt out. In all other cases, you have to be covered in PF.

If you have a basic salary of more than 15,000/-, it would not be mandatory for the company to offer you membership of EPFO, whether you have an existing UAN number or not.
As per Shaswat Banerjee, "If you joined earlier but the company is now covered under PF and your salary on that day was above ₹15,000 then also you cannot opt-out" is not correct. When the establishment is covered under the EPF Act, and the member has had a previous PF membership, the establishment should deduct PF up to Rs. 15,000. There is no option not to deduct.
