Married Coworkers in the Same Department: Should One Really Have to Leave?

Dear Sir,

Two employees of our company fell in love and got married. Both are working in the same department. Now, someone informed the GM that they both cannot work in the same department and the same company. One has to leave the company. Can anyone provide some ruling on the matter or guide me further?

1. There is no such law, and it cannot go against it either. Only company policy deals with such terms.

2. What are the disadvantages of keeping a married couple in the same department, except for when they take leave at the same time?

3. The advantage is longer stability and bonding with the organization. If leave could affect them, consider changing one of their departments.

There is no law that says a husband and wife cannot work in the same company or department. Sometimes, if the department or nature of work is sensitive, it is advisable to keep them separate. In fact, removing one of the pair due to the fact of marriage can legally go against the company.

Apart from legality, in my view, looking at a husband and wife working in the same company or department with apprehension of potential problems is immature and unhealthy. If reasons are given due to their conduct or work habits which adversely affect the working of the company or department, in such a proven situation, the most appropriate action may involve transferring or changing their roles, but certainly not forcing one of the partners to leave. Therefore, your organization should provide them with a full opportunity to work with a positive attitude unless and until they prove themselves unworthy of your belief and faith through their conduct.
