Minimum Wage Confusion: Do We Follow Shops and Establishments Rates in Factories and Hospitals?

We are a facility management company registered under Shops and Establishments. We are securing contracts in factories, hospitals, and the central sphere.

The question is, are we required to follow the Shops and Establishments minimum wages when working in factories and hospitals, or do we need to adhere to the minimum wage specific to each category?

You need to follow the minimum wages as per a particular category and cannot keep any fixed amount for all categories. It is only okay if you are paying over and above the minimum wages.

Applicable minimum wages should be paid to the contract employees posted to the respective establishment of the principal employer. The employees are not working in your establishment; rather, they are posted to your client's establishment.

Dear Mr. Gopalmaru,

The classification of staff in various categories is notified by the Labour Department, and the minimum wages to be paid are also specified. For example, please refer to the State of Delhi notification number 12(28)/142/11/MW/LaB 2016 dated 26/07/2011. As rightly pointed out, the specified minimum wages are the least the employees are required to be paid.
