Gratuity Concerns: Is It Applicable if an Employee Passes Away at Work?

Greetings for the day! For example, if an employee dies during working hours after working for 3 years, is gratuity applicable or not?

Dear Mr. Jithin,

The minimum service of 5 years is not applicable for death while in service. Consequently, the employee in question is eligible for gratuity for the service rendered.

I have a query: if any employee's service is less than six months at the time of his death while on duty, will his nominee be entitled to payment of Gratuity under Section 4(c) of the Payment of Gratuity Act, 1972?

If an employee dies even with one year of service, their nominees are entitled to receive gratuity. Therefore, three years of service will definitely entitle them to gratuity payment.
