Do Insurance Intermediaries in India Need Registration Under the Shops and Establishment Act?

Please explain whether an Insurance Intermediary registered with the Insurance Regulatory Authority of India and licensed by the same authority needs to get registered under the said act.

Dear Mr. Ramachandrarao,

I would like to invite your attention to Sections 2(5), 3, and 73(1)(b) of the Andhra Pradesh Shops and Establishments Act, 1988. As per the definition of the term "Commercial Establishment" under Section 2(5), an insurance company is considered a commercial establishment under the Act. It is important to note that every insurance company can only commence operations after registering with the Insurance Regulatory Authority of India, and the same applies to an insurance intermediary.

However, Section 73(1)(b) of the APSE Act, 1988, provides an exemption for Central Government establishments from the provisions of the Act. Therefore, all private insurance companies and private intermediaries must register under Section 3 of the APSE Act, 1988.
