Can My Elder Sister, as My Guardian, Access ESI Medical Benefits After Our Parents' Passing?

Tasleem Fatima
Dear all,

I am Tasleem and I work in a private organization. Unfortunately, both of my parents have passed away. Will my elder sister be eligible for ESI Medical benefits as she is my guardian? If so, please provide details on the procedure.

Regards,
Tasleem

Elder sister of the insured person will not fall under the definition of Family Members under the ESI Act. Consequently, she will not receive any benefits. However, please check your ESI E Pehchan Print to see if your elder sister's name is listed there.

If the age of the sister is 18/21 (need to refer to the ESI Act), then in any case, she will not come within the definition of a family dependent, so she cannot avail benefits under the Act.
